Judge Dismisses Sidewalk Chalkers Case

Las Vegas CBS KXNT – A judge dismissed the case Friday against four activists who were charged with conspiracy to deface public property when they chalked the sidewalk with criticism of the Las Vegas Metro Police.

Defense attorney Robert Langord said his clients, who did not appear in court, would consider the dismissal a victory.

But Langford expressed disappointment about a written statement from the Clark County District Attorney’s office, announcing it would not pursue the case further, and citing “implied consent” for the chalking because marshals at the Regional Justice Center were aware that the activists were writing on the sidewalk and didn’t stop them.

Lanford told KXNT the victory would have been more complete had there been acknowledgment that the four were engaging in a protected activity, and should not have been arrested in the first place.

The case was dismissed with prejudice, which means the charges can’t be refiled.
