Award To Injured Palms Patron Overturned

LAS VEGAS (AP) — The Nevada Supreme Court has overturned a lower court ruling that awarded $6.6 million to a man injured while watching Monday Night Football at the Palms casino.

Justices issued the ruling Thursday, saying a judge improperly allowed some witnesses and excluded others.

The case stems from an incident Nov. 22, 2004, when patron Enrique Rodriguez was watching a football game at the Las Vegas casino. An actress dressed as a cheerleader was throwing prizes to the crowd, and a female patron who dove to grab a souvenir water bottle hit Rodriguez’s knee.

Rodriguez later sued, saying the casino had allowed an unsafe activity.

His attorney argues that the injury required two surgeries and caused years of pain.

A judge awarded millions for medical expenses, pain and suffering and lost wages.
