(Carson City, NV) — The Nevada Supreme Court says a debtor can’t claim a homestead exemption unless he or she lives in the home.

In a unanimous decision, Justices ruled David Nilsson could not claim the exemption for a home he bought with his ex-wife, even though she and their three children still live there.

A bankruptcy judge challenged the homestead exemption, after learning Nilsson moved out of the home in 2006.
