(LAS VEGAS, KXNT)–O.J. Simpson’s lawyers say they will appeal a judge’s ruling last week denying him a re-trial in the robbery and kidnapping case that sent him to prison.

The filing with the state supreme court is notice that Simpson’s lawyers will file that appeal by the middle of January.

Last week Judge Linda Marie Bell denied the 66 year old Simpson a re-trial. He’s serving a 9 to 33 year term here in Nevada in an incident at Palace Station in 2007 in which the one-time football great tried to retrieve sports memorabilia.

His attorneys appealed for a re-trial on 22 separate grounds, claiming an inadequate defense
