LAS VEGAS (KXNT/AP) — A Saudi Arabian air force sergeant won’t testify before jurors decide whether he’s guilty of raping 13-year-old boy at the Cicruc Circus hotel last New Year’s Eve.

Attorney Don Chairez and a prosecutor say Mazen Alotaibi is giving up his right to take the stand in his defense.

Closing arguments will take place Tuesday afternoon.

That will leave it to jurors to decide if evidence and testimony proves the 24-year-old Alotaibi guilty of charges including kidnapping, sexual assault and lewdness with a child.

He could get life in prison if he’s convicted.

A DNA expert and female friend of a man who was part of Alotaibi’s group testified in his defense on Monday.

Chairez maintains that DNA evidence is inconclusive and the boy consented to sex.
