(Las Vegas, NV) — More delays are possible in the trial against the doctor at the center of the valleys 2008 hepatitis outbreak.
Lawyers for Dr. Dipak Desai have asked the state Supreme Court to overturn a judge’s order that limits the number of witnesses at an upcoming hearing challenging state medical experts who ruled Desai is competent to stand to stand trial.
His defense team contends strokes have left him unable to assist them. If the high court puts off the hearing, it could make it more difficult to meet the March 12 trial date.
The 61-year-old, Desai and two of his nurses are facing felony charges, including racketeering, insurance fraud and neglect of patients, revolving around seven people who authorities say were infected with the potentially deadly hepatitis C virus at Desai’s clinics.
